Terms and Conditions for Accommodation Contract / Rules of Use

Article 1 (Scope of Application)

1. The Accommodation Contract and related agreements to be concluded between the Hotel and the Guest shall be subject to the following terms and conditions. Any matters not stipulated herein shall be governed by laws and ordinances and/or generally established practice.
2. When the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and ordinances and generally accepted practices, notwithstanding the preceding paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.

Article 2 (Refusal of Accommodation Contract)

The Hotel may refuse to provide accommodation in the following circumstances:
1. When the accommodation requested does not fall under these provisions.
2. When the Hotel is booked fully and no rooms are available.
3. When the Guest seeking accommodations is deemed liable to conduct themself in a manner that will contravene the laws or act against public order or good morals in regard to the accommodation.
4. When the Guest seeking accommodation can be clearly identified as carrying an infectious disease.
5. When the Hotel is requested to bear a special burden in regard to the accommodation.
6. When the Hotel is incapable of providing the accommodation due to unavoidable causes, such as a natural calamity or damage to its facilities.
7. When the Guest seeking accommodation can be clearly identified as being highly intoxicated and likely to cause serious inconvenience to other guests.
8. When the Guest brings in dangerous materials (including products that may cause fire such as stoves or gasoline) or materials harmful to humans.
9. When the Guest falls under the provisions of Article 7 of the Kyoto Hotel Business Act Enforcement Ordinance.
10. When Article 10 hereof has been applied in the past to the Guest seeking accommodation.
11. When the Guest seeking accommodation is a minor.
12. When the Guest seeking accommodation is deemed to fall under any of the following:
When the Guest seeking accommodation is deemed to be an organized crime group defined in Article 2, Item 2 of the “Act on Prevention of Unjustifiable Acts by Organized Crime Group” (Act No. 77 of 1991) (hereinafter referred to as “Organized Crime Group”), or an organized crime group member defined in Article 2, Item 6 of the same act (hereinafter referred to as “Organized Crime Group Member”), or an organized crime group quasi-member, or an organized crime group affiliate or other antisocial force;
When the Guest seeking accommodation is a corporation or other group of which business activities are under control of the Organized Crime Group or the Organized Crime Group Member;
When the Guest seeking accommodation is a corporation which any of officers is proven to be an Organized Crime Group Member.
13. When the Guest seeking accommodation makes a violent demand or demands a burden outside a reasonable range to the Hotel in regard to the accommodation.
14. When circumstances similar to the forgoing items apply.

Article 3 (Registration of Accommodation)

1. A Guest who intends to apply for an Accommodation Contract with the Hotel shall register the following:
1. Address, name, telephone number and gender of the Guest;
2. Nationality, passport number, port and date of entry in Japan if the Guest is a foreigner;
3. Date of accommodation, estimated time of arrival, departure date, estimated time of departure, telephone number and name of the applicant;
4. Where the Guest intends to make payment provided for in Article 9 by any means other than Japanese currency including credit cards, such credit card information (which shall be shown in advance at the time of registration prescribed in the preceding paragraph);
5. Other particulars deemed necessary by the Hotel.
2. If during the Guest’s stay, they request to extend their stay beyond the date of the stay set forth in Item 3 of the preceding paragraph, the Hotel shall treat such request as having applied for a new accommodation contract at the time such request is made only if the Hotel has no reservation.

Article 4 (Conclusion of Accommodation Contracts)

1. A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding article. However, depending on the accommodation plan, the Hotel requests the Guest to pay in advance after the application referred to in the preceding article, and in which case, a Contract for Accommodation shall be deemed to have been concluded when the Hotel has confirmed the payment. The same shall not apply when it can be proved that the Hotel has not accepted the application.
2. The deposit shall be used firstly for the accommodation charges to be finally paid by the Guest, and if any circumstances requiring application of the provisions of Article 5 have arisen, then secondly for any cancelation fee, and thirdly for any reparations as applicable, and the remainder, if any, shall be refunded.
3. If the Guest has failed to pay the deposit referred to in the preceding paragraph by the date specified by the Hotel as stipulated in the provisions of the same paragraph, the Hotel shall treat the Accommodation Contract as invalid.
4. Reservations are accepted for dates up to the final day of the sixth month from the first day of every month.

Article 5 (Cancelation of Reservation)

In cases where the Guest has canceled the accommodation reservation in whole or in part, the Guest shall pay a cancelation fee as prescribed in the followings.

1. Terms for cancelation fee is: for cancelations made on the accommodation date to seven days prior to the accommodation date, 100% of accommodation charges for reserved accommodation schedule; and for cancelations made from the day of reservation to eight days prior to the accommodation date, 50% of accommodation charges for reserved accommodation schedule.
2. In a case when the Guest does not appear by 8 p.m. on the accommodation date, or two hours after the expected time of arrival (up to 8 p.m. as the limit) without advance notice, the Hotel may regard and treat the Accommodation Contract as being canceled by the Guest.
3. When the number of days contracted is shortened, the Hotel shall receive payment at the same rate as per the cancelation fee for the reserved accommodation schedule based on the accommodation charges, regardless of the reduced number of days.
4. In the event that, in accordance with the preceding paragraph, a reservation is deemed to have been canceled, but the Guest proves that the reason for the no-show without notice was the non-arrival or delay of a train, passenger plane, or other public transport, or some other reason that is not attributable to the Guest, the cancelation fee specified in Paragraph 1 shall not be charged.

Notes:
1. The percentage is the ratio of the cancelation fee against the accommodation charges for the reserved accommodation schedule.
2. In the event that the number of days contracted is shortened, the Hotel shall receive payment at the same rate as per the cancelation fee for the reserved accommodation schedule based on the accommodation charges.

Article 6 (Right to Cancel Accommodation Contract by the Hotel)

The Hotel has the right to cancel an accommodation reservation in the following cases unless other provisions are provided:

1. When the Guest falls under Article 2, Item 3 or Item 14.
2. When the Guest does not register the particulars prescribed in Article 3, Paragraph 1.
3. When the deposit has not been paid to the Hotel on time in a case where the Hotel requested such deposit referred to in Article 4.

In cases where the accommodation reservation has been canceled in accordance with the provisions of the preceding paragraph, the Hotel shall refund any deposit already received for the reservation.

Article 7 (Check-in and Check-out Time)

1. The time from which the Guest can check-in (check-in time) is 3 p.m. and the time from which the Guest must leave the Hotel (check-out time) is 10 a.m.
2. The Hotel will not approve an extension of stay beyond 10 a.m. unless otherwise approved by the Hotel.
3. In a case where the Guest is being accommodated continuously (for more than two days), the Guest may occupy the room all day long, except for the day of arrival and departure. However, cleaning staff may enter the room if cleaning of the room is required.

Article 8 (Payment of Accommodation Charges)

The accommodation charges shall be paid on or before the date designated by the Hotel in such manner as the Hotel or a travel agency may specify including via direct deposit (amount equivalent to the accommodation charges) into a nominated bank account (remittance) or credit card or payment at the Hotel. The accommodation charges shall be paid even if the Guest voluntarily does not stay at the Hotel after the room has been made available to the Guest.

Article 9 (Rules of Use)

The Guest shall observe the rules of use established by the Hotel (hereinafter referred to as “Rules of Use”) within the premises of the Hotel.

Article 10 (Refusal of Continued Accommodation)

The Hotel may, in the following situations, refuse to allow the Guest to continue their stay even during an agreed accommodation period.

1. When the Guest falls under Article 2, Item 3 to Item 14.
2. When the Guest has brought someone who is not a registered guest into the room.
3. When the Guest has not abided by the Rules of Use.
4. When the Guest has smoked in the bedroom, has damaged fire-fighting equipment, or has otherwise violated prohibitions in the Rules of Use established by this Hotel.

Article 11 (Responsibility of the Hotel)

1. The responsibility of the Hotel concerning accommodation starts from the time the Guest is registered at the Hotel or when the Guest enters their room, whichever was earlier, and terminates at the time the Guest leaves their room to depart the Hotel.
2. When the Guest can no longer be accommodated due to reasons for which the Hotel is responsible, the Hotel shall arrange to secure accommodation of similar accommodation charges for the Guest at facilities elsewhere, except in cases of natural calamities and other causes making its observance difficult. In such a case, there shall be no charge to the Guest for the accommodation at the Hotel for the day.
3. In the case of the preceding paragraph, the Hotel cannot be held responsible for compensation greater than the amount of accommodation charges.

Article 12 (Handling of Deposited Articles)

1. The Hotel does not handle or keep deposited articles.
2. The Hotel shall not be liable for the loss or destruction of the possessions of Guests brought into the Hotel by the Guest, including cash and other valuables, unless there was intention or gross negligence by the Hotel.

Article 13 (Custody of Baggage and Belongings of the Guest)

1. The Hotel cannot accept or keep the Guest’s baggage and belongings prior to arrival.
2. When the Guest checks out leaving baggage or belongings (including items in the safe), the Hotel shall keep such items for 180 days including the day on which they were discovered, and after the seven-day period has elapsed, the valuables will be taken to the nearest police station, and other items will be disposed of by the Hotel.

Article 14 (Parking Space)

The Hotel has no parking space for Guests.

Article 15 (Responsibility of the Guest)

1. The Guest shall compensate the Hotel for any damage caused intentionally or through negligence on the part of the Guest (including when the Guest takes away Hotel items).
2. When other guests breach the Rules of Use and cause any accident including damage to the Guest, or when the Guest breaches the Rules of Use and suffers any damage, the Hotel shall not be liable for the damage.

Article 16 (Jurisdiction and Governing Law)

Any dispute arising in connection with these Terms and Conditions for Accommodation Contract shall be referred to the exclusive jurisdiction of Tokyo District Court in the first instance and resolved in accordance with Japanese laws.

Rules of Use for the Hotel

Article 1 (Scope of Application)

To ensure the comfort and safety of the Hotel, we ask Guests to abide to the following house rules according to Article 9 of Kyoto House Terms and Conditions for Accommodation Contract. If Guests fail to observe these Rules, we may terminate the continuous accommodation in accordance with Article 10 of the Kyoto House Terms and Conditions for Accommodation Contract.

1. Please do not use sources of fire in the Hotel’s premises.
2. Please do not smoke in the Hotel’s premises.Include vape (electronic cigarettes).
We will charge 33,000 yen for the cleaning fee when smoking or cigarette butts are confirmed.
If we receive a complaint from neighbors, you will be asked to leave the house for violating the rules of use.
Please note that Kyoto City promotes the prevention of smoking on streets and in parks, and there are areas where a fine will be collected.
3. The Hotel is a wooden building situated in a general residential area, thus please refrain from singing loudly, making noises, or any other behavior that would cause annoyance for the surrounding neighbors, including behavior that may be deed unpleasant.
4. Please do not carry the following into the Hotel’s premises:
(1) Animals and birds
(2) Items that emit foul odors
(3) Items of great quantity
(4) Volatile or ignitable items such as explosives and gasoline
(5) Firearms and weapons that are not legally approved
(6) Marijuana, drugs, amphetamines, etc.
5. Please refrain from gambling and behaving in any demoralizing manner in the Hotel.
6. Please do not bring visitors into the Hotel, and do not move, modify or remove facilities, furniture and goods in the Hotel’s premises or use them for purposes other than the original purpose.
7. Please do not attach items to the buildings and facilities in the Hotel’s premises or move hotel facilities to other places in the Hotel.
8. The Hotel has many floors, thus please watch your step on the stairs and do not lean over the railings.
9. Please do not use the Hotel while intoxicated.
